Terms and Conditions of Use for Jineteando.com

  1. Acceptance of Terms

By accessing or using Jineteando.com (“Platform”, “Website”, or “Service”), owned and operated by Jineteando, LLC (“Company”, “we”, “us”, “our”), you (“User”, “you”) hereby affirmatively acknowledge and agree that you have read, understood, and accepted in full the following Terms and Conditions of Use (“Terms”), along with the Privacy Policy and any other operating rules, guidelines, policies, or procedures that may be published from time to time by Jineteando, LLC, all of which are hereby incorporated by reference. If you do not agree with any of these provisions, you must immediately cease accessing or using the Platform.

Continued use of the Platform by you shall constitute a conclusive and binding acknowledgment of your acceptance of all such terms, including any modifications or amendments that may be made at the sole discretion of the Company.

  1. Eligibility

Use of this Platform is strictly limited to individuals who are:

  • At least eighteen (18) years of age, or the applicable age of majority in their respective jurisdiction, whichever is greater;
  • Possessing full legal capacity and authority to enter into binding contracts under the laws of their respective jurisdiction; and
  • Not accessing the Platform from a location where such access would violate any applicable local, regional, national, or international law, regulation, ordinance, or public policy.

Any false representation regarding eligibility shall constitute a material breach of these Terms.

  1. User Conduct and Assumption of Risk

You acknowledge and expressly agree that the nature of services provided through this Platform involves interaction with unknown individuals, some of whom may engage in criminal, abusive, deceptive, fraudulent, violent, or sexually exploitative conduct. Accordingly, you voluntarily accept and assume all inherent and incidental risks, including but not limited to:

  • Physical injury, emotional trauma, psychological harm, disease transmission, criminal victimization, financial loss, and death.

By participating in or making use of any Platform features:

  • You voluntarily and irrevocably waive any and all present or future claims, causes of action, or liabilities, whether known or unknown, against Jineteando, LLC and its directors, officers, employees, affiliates, licensors, successors, and assigns;
  • You acknowledge that Jineteando does not promote or encourage irresponsible, unlawful, or dangerous behavior, and makes no representations as to the safety or intent of any user;
  • You are solely responsible for employing personal discretion, safety precautions, and due diligence when interacting with other users both online and in person.
  1. Prohibited Use

The Platform may not be used for any unlawful, unethical, or otherwise unauthorized purposes, including but not limited to:

  • Facilitating, promoting, or engaging in human trafficking, prostitution, non-consensual sexual acts, or commercial sexual exploitation;
  • Distributing, soliciting, or posting revenge pornography, child sexual abuse material (CSAM), obscenity, or any non-consensual or voyeuristic content;
  • Committing fraud, harassment, impersonation, defamation, doxing, stalking, or intimidation;
  • Engaging in spamming, scraping, hacking, or circumventing Platform security features, access protocols, or data management systems.

Violation of this provision may result in immediate termination of access, permanent deletion of user data, and prompt notification to the appropriate law enforcement agencies.

  1. Reporting Misuse

Users are affirmatively obligated to report any and all suspicious, abusive, or illegal conduct occurring on the Platform, including but not limited to:

  • Suspected instances of sex trafficking, exploitation, or coercion;
  • Non-consensual distribution of intimate or personally identifiable content;
  • Copyright infringement or violation of intellectual property rights.

All reports must be submitted via email to: [email protected], including a detailed factual summary and supporting documentation where available. The Company will make reasonable efforts to review all reports within seventy-two (72) business hours; however, no guarantee of outcome, confidentiality, or resolution is made or implied.

  1. User-Generated Content (UGC)

By submitting, uploading, transmitting, or otherwise making available any content, including but not limited to photographs, videos, biographical information, commentary, messages, or profile details (collectively, “User-Generated Content” or “UGC”) through the Platform, you hereby:

  • Represent and warrant that you possess all rights, licenses, consents, and authority necessary to use and authorize Jineteando to use such UGC;
  • Grant Jineteando, LLC a worldwide, irrevocable, perpetual, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, display, and distribute such UGC in any medium or manner now known or later developed;
  • Waive any and all claims to moral rights, self image rights or rights of attribution with respect to such content;
  • Acknowledge that you are solely and exclusively responsible for your UGC and that Jineteando, LLC bears no liability or responsibility for its use, dissemination, or impact;
  • Agree that Jineteando, LLC shall not be liable to you or to any third party for any loss, injury, harm, damage, or death arising from or related to UGC;
  • Further acknowledge that other users may post content that is offensive, inaccurate, misleading, unlawful, or objectionable, and you waive any right to hold Jineteando, LLC responsible for such third-party content.
  1. Monitoring and Enforcement

Jineteando, LLC reserves the unilateral and discretionary right (but not the obligation) to:

  • Monitor any and all user activity, communications, and content submissions;
  • Investigate reported or suspected violations of these Terms;
  • Suspend, restrict, or permanently terminate any account, at any time, with or without cause or notice;
  • Take legal action or cooperate with law enforcement as necessary to ensure the safety, integrity, and lawful operation of the Platform.
  1. Account Termination and Deletion

We reserve the right to suspend, restrict, or permanently delete any user account, with or without cause or justification, and without prior notice, at our sole discretion. Such termination may include the deletion of all User-Generated Content, data, or profile history associated with the account. No liability shall be imposed upon Jineteando, LLC for any losses, damages, or inconveniences arising from such termination.

  1. DMCA Compliance

Pursuant to the Digital Millennium Copyright Act (“DMCA”), we respond to properly submitted notifications of alleged copyright infringement. To file a DMCA notice, the following information must be submitted in writing to [email protected]:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the allegedly infringing material and its location on the Platform;
  • Your contact information (name, address, email, phone number);
  • A statement that you have a good faith belief that the use of the material is not authorized;
  • A statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.

We may remove the allegedly infringing material and terminate access to repeat infringers.

  1. Takedown and Dispute Resolution Process

Upon receipt of any complaint, notice, or report regarding a user or content:

  • Initial Review: We will evaluate submissions within seventy-two (72) business hours;
  • Content Action: Content may be restricted, suspended, or removed during the review period;
  • User Notification: Users implicated in the report will be notified and may respond or file a counter-notice;
  • Appeals: A single appeal may be submitted for re-evaluation by our internal compliance team;
  • Final Decision: All determinations are final and not subject to further review or legal challenge.
  1. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JINETEANDO, LLC, ITS AFFILIATES, EMPLOYEES, DIRECTORS, OR REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, EMOTIONAL DISTRESS, LOSS OF DATA, LOSS OF PROFITS, OR DEATH, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  1. No Warranties

THE PLATFORM IS PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS. JINETEANDO, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE SECURITY, RELIABILITY, OR PERFORMANCE OF THE PLATFORM.

  1. Mandatory Arbitration and Class Action Waiver

All disputes arising from or related to these Terms or use of the Platform shall be resolved exclusively by binding arbitration administered by the American Arbitration Association in accordance with its commercial arbitration rules. The arbitration shall be conducted in San Juan, Puerto Rico, in the English language.

Users hereby waive any right to pursue claims in court or to participate in any class action or representative proceeding.

  1. Governing Law

These Terms and all matters relating to their interpretation and enforcement shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to conflicts of law principles.

  1. Modifications to Terms

Jineteando, LLC reserves the right to modify or amend these Terms at any time and for any reason. Updates will be posted to the Platform with an updated “Effective Date.” Continued use of the Platform following such changes constitutes your acceptance of the modified Terms.

Jineteando, LLC reserves the right to sell, license, or otherwise transfer anonymized and aggregated user data to third parties, including advertisers, research institutions, data brokers, and analytics partners, provided that such data does not include personally identifiable information such as names, email addresses, or government-issued identifiers. Such transfers may be conducted for commercial purposes including, but not limited to, market research, behavioral targeting, and product development.

We do not sell or rent your personal information for direct monetary gain.

  1. Security of Data

We implement commercially reasonable security measures to protect your information. However, no method of transmission over the internet or method of electronic storage is 100% secure. You acknowledge that you use the Platform and provide data at your own risk.

Jineteando shall not be liable for any damages, including but not limited to identity theft, reputational harm, emotional distress, or financial loss, resulting from data breaches unless otherwise mandated by applicable law.

  1. Mandatory Arbitration and Class Action Waiver

All claims, disputes, or controversies arising from or related to this Privacy Policy, the Platform, or the handling of user data shall be resolved exclusively by binding arbitration administered by the American Arbitration Association in accordance with its commercial rules. The arbitration shall take place in San Juan, Puerto Rico, in the English language.

Each party expressly waives the right to bring any action in court, including class actions or representative lawsuits. Arbitration shall be the sole and exclusive remedy for any claim.
